VW says Texas is imposing penalties for invalid emissions regulations

By Emily Field (Oct 19, 2021, 6:43 p.m. EDT) – Volkswagen told a Texas court on Monday that the state of Lone Star cannot attempt to penalize the German automaker for recalls to reduce emissions between 2014 and 2016, because they are trying to enforce an emissions manipulation rule that has never existed before.

Volkswagen is pending a ruling preventing Texas and certain counties from making claims under a state law that prohibits tampering with exhaust systems in automobiles because the Texas Commission on Environmental Quality did not review the rule as required by law – and therefore the rule did not was valid in the period 2014-2016.
